Is THCA legal in Texas?

Texas is the biggest THCA market to close. The DSHS rules counting THCA are enforceable while the industry appeals, and the federal date arrives Dec. 11 either way.

The short answer: Not as hemp. Texas Department of State Health Services rules in force since March 31, 2026 count THCA toward total THC and restrict smokable hemp. A court blocked them on May 1; an appeals court lifted that block in June, and the industry’s appeal is pending. Texas has no adult-use market. Status as of Oct. 3, 2026.

The rules that changed the market

DSHS published its adopted consumable hemp rules in the March 20, 2026 Texas Register, effective March 31, according to the agency’s Consumable Hemp Program page. The “total THC” approach counts THCA at about 88 percent of its weight as delta-9 for compliance, restricts smokable hemp flower and concentrates, and raises annual fees, with retail registration going from $150 to $5,000 per year and manufacturing licenses from $250 to $10,000, as Texas Public Radio reported.

Two earlier pieces sit underneath. In 2022 the Supreme Court of Texas upheld the statute barring the “processing or manufacturing of a consumable hemp product for smoking,” Health and Safety Code 443.204(4), while a lower-court injunction continued to allow retail sale. And on Oct. 2, 2025, DSHS adopted emergency rules setting a 21-and-over limit with ID checks, enforceable by revoking a license or registration.

The lawsuit, briefly

Hemp businesses sued in Travis County in April. A temporary injunction on May 1 blocked the rules; the Fifteenth Court of Appeals lifted it in early June, and the rules have been enforceable since. Texas Public Radio noted that the appeals court had not yet ruled on whether the rules are lawful, only on whether they could be enforced in the meantime. Conflict flag: some guides still call Texas a “gray area.” With the rules enforceable, we classify the hemp lane as closed and will revise if the court restores the injunction.

Possession and the medical program

Flower that fails the hemp test is marijuana under Texas law, and possessing marijuana remains a criminal offense under Health and Safety Code 481.121. The Texas Compassionate Use Program lets registered patients obtain low-THC cannabis from licensed dispensing organizations; it is not a source of high-THCA flower for the general public. Gov. Greg Abbott vetoed SB 3, a broader THC ban, in 2025, which is why the change came by agency rule instead of statute.

Dec. 11, 2026: a second door closes

The state case cannot reopen the federal one. If the hemp industry won in Austin tomorrow, high-THCA flower would still become federal marijuana on Dec. 11, 2026, when THCA joins the federal hemp count (federal timeline), unless Congress delays it again.

  • A certificate of analysis showing low delta-9 does not meet the DSHS standard; the total THC line does the work.

What is the age limit for hemp products in Texas?

Is delta-8 legal in Texas?

No. DSHS says a change to the Texas controlled substances schedule affecting delta-8 THC took effect July 31, 2026, and the Supreme Court of Texas has confirmed that delta-8 is a controlled substance apart from naturally occurring trace amounts.

Does Texas have legal dispensaries?

Only for registered patients in the Texas Compassionate Use Program, which supplies low-THC cannabis. Texas has no adult-use market.
