Is THCA legal in Virginia?

Virginia is the odd case: adults may possess cannabis, hemp THCA flower is out, and the licensed stores that would sell it do not open until July 1, 2027.

The short answer: Not as hemp. Virginia limits hemp products to 0.3 percent total THC, a measure that counts THCA, and since Aug. 15, 2026 to 2 milligrams of total THC per package. Adults 21 and over may possess up to 2 ounces of marijuana, but licensed adult-use stores do not open until July 1, 2027. Status as of Oct. 3, 2026.

Total THC has been the rule since 2023

Virginia counted THCA before most states did. Va. Code 3.2-4112, as rewritten in 2023, defines “total tetrahydrocannabinol” as “the sum, after the application of any necessary conversion factor, of the percentage by weight of tetrahydrocannabinol and the percentage by weight of tetrahydrocannabinolic acid.” A hemp product offered for retail sale may contain no more than 0.3 percent of it.

The same section set a per-package limit of 2 milligrams of total THC, with an escape hatch: a product could exceed it if it held at least 25 times as much CBD as THC.

What changed Aug. 15, 2026

The 2026 budget, House Bill 30, closed the escape hatch. The Virginia Department of Agriculture and Consumer Services put it plainly on July 1: “Beginning August 15, 2026, a product with more than two milligrams of total THC per package cannot be produced or sold as a hemp product in Virginia.” The “25:1 ratio” is gone.

HB 30 also moves hemp enforcement from VDACS’s Office of Hemp Enforcement to the Virginia Cannabis Control Authority, which SB 543 gives new power to issue notices of violation, cease-and-desist orders and civil penalties against unlicensed cannabis and hemp businesses.

Hemp retailers sued. A federal judge denied a temporary restraining order against the 2-milligram limit on Aug. 14, Virginia Mercury reported; the case, M.O. Tropi v. Spanberger, continues.

Virginia’s position confuses visitors. Since 2021, adults 21 and over may possess marijuana; the current limit in public is 2 ounces. But no one may sell it at retail until the licensed market opens on July 1, 2027, under HB 30. Registered medical cannabis patients can buy from the state’s licensed medical dispensaries in the meantime.

So the honest summary: possessing a reasonable amount of cannabis is legal for adults; buying THCA flower as hemp is not; buying it as cannabis at a store is legal only for patients until mid-2027.

The crop rule follows; the package rule does not

Virginia’s “industrial hemp” definition tracks “that allowed by federal law,” so the crop-level change to counting THCA on Dec. 11, 2026 (federal change) follows automatically. The federal 0.4-milligram per-container cap is stricter than Virginia’s 2 milligrams, and the package limit will need a state decision.
