Is THCA legal in West Virginia?

West Virginia regulates hemp THC rather than banning it: permits, a 21+ rule, and a law that reaches out-of-state online sellers. How it treats THCA flower is less clear.

The short answer: Restricted, and unclear for flower. West Virginia lets permit holders sell hemp-derived cannabinoid products to adults 21 and over, and its law reaches out-of-state online sellers, but its statute caps delta-9 at a “total concentration” of 0.3 percent, wording that can be read to count THCA. A regulated lane, not an open one

West Virginia chose to license hemp THC rather than ban it. W. Va. Code 19-12E-12, the Select Plant-Based Derivatives Regulation Act, says its purpose is “to allow limited, regulated access to select plant-based derivatives which are naturally occurring… for adults 21 years of age and older.”

The act requires a permit from the Commissioner of Agriculture for “any person manufacturing, processing, distributing, offering for sale, or selling any hemp-derived cannabinoid products in this state,” and the department publishes the list of permit holders. Retail sales also involve the Alcohol Beverage Control Administration, which the act names.

It reaches online sellers

The act is unusually direct about remote sales. Businesses “located outside of this state that are engaged in the remote distribution or remote retail sale of hemp-derived cannabinoid products across state lines for delivery into this state, are subject to the permitting, labeling, and other control and administration provisions of this article.” They must obtain a West Virginia business registration certificate, and the state asserts tax and regulatory jurisdiction over the sale. An out-of-state website shipping to a Charleston address without a West Virginia permit is outside the law on that point alone.

The THC wording problem

The act defines a “hemp-derived cannabinoid” to include “Delta-9 tetrahydrocannabinol with a total concentration of not more than 0.3 percent on a dry weight basis,” along with delta-8, delta-10, HHC, THCp and THCv. The hemp definition elsewhere in the article, 19-12E-3, sets a limit of “no greater than 0.3% tetrahydrocannabinol, or the THC concentration for hemp defined in 7 U.S.C. § 5940, whichever is greater.”

Neither sentence names THCA. But “total concentration” is the phrase federal and state labs use for delta-9 after THCA is converted. Read that way, high-THCA flower is not a permitted hemp-derived cannabinoid.

Conflict flag: several guides call West Virginia simply “legal.” The primary text supports “restricted,” and the THC wording supports caution about flower specifically. We take the stricter reading.

The medical lane

West Virginia’s Medical Cannabis Act lets registered patients buy from licensed dispensaries, including dry-leaf flower. Adults without a patient card have no licensed outlet for high-THCA flower. Bills to change the hemp framework were introduced in 2026, but we found none enacted that would alter this page as of Oct. 3.

Permitted products and federal limits

Federal law settles West Virginia’s THC wording question on Dec. 11, 2026, when it begins counting THCA (federal change). After that, most of the delta-8, HHC and other products the state act permits will exceed federal limits as well.
