Is THCA legal in Wisconsin?

THCA flower is on Wisconsin shelves, and most guides call the state open. The statute's own testing words point the other way, and Dec. 11 settles it federally.

The short answer: Sold openly, legally contested. Wisconsin’s hemp definition, Wis. Stat. 94.55, measures delta-9 THC at 0.3 percent “as tested using post-decarboxylation,” a method that converts THCA into delta-9. Read literally, high-THCA flower fails it. No 2026 bill passed, and federal law counts THCA from Dec. 11, 2026. Status as of Oct. 3, 2026.

The sentence most guides skip

Wisconsin is usually listed with Florida and North Carolina as a state that kept the old delta-9 test. The first half of the definition supports that. Section 94.55(1) defines hemp as the plant and its derivatives “with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis or the maximum concentration allowed under federal law up to 1 percent, whichever is greater.”

The sentence does not stop there. It ends: “as tested using post-decarboxylation or other similarly reliable methods.”

Decarboxylation is the step, usually heat, that turns THCA into delta-9 THC. A post-decarboxylation result therefore reports delta-9 plus converted THCA, the same number a total-THC calculation produces. Applied to a typical THCA bud, that test returns a figure in the high teens or twenties, not under 0.3.

Conflict flag: most consumer guides, and an earlier version of our own research, list Wisconsin as open to THCA flower, and stores across the state sell it. The statute’s testing clause supports a stricter reading. We found no court decision or published state enforcement position resolving it. Following our rule of taking the stricter reading when sources conflict, we call the status contested rather than open.

The “whichever is greater” clause will not help after Dec. 11: the federal maximum is about to become stricter, not looser.

The 2026 bills

Two approaches were offered in the 2025-2026 session: a ban on intoxicating hemp products, and a bill from Rep. Rob Swearingen and Sen. Patrick Testin to regulate them with a 21-and-over rule. Neither left committee, FOX 11 Investigates reported. As a result there is no state age minimum for hemp THC products; age checks are store policy.

No licensed fallback

Wisconsin has no adult-use market and no comprehensive medical program; it allows only narrow CBD-oil possession for certain conditions. For adults, the hemp aisle is the only channel, and its legal footing is thinner than shelf displays suggest.

Shipping and the mail after Dec. 10

Once federal law counts THCA in its hemp test on Dec. 11, 2026 (federal timeline), the Wisconsin state-law argument stops mattering for interstate shipments and the mail, which follow federal law.
