Is THCA legal in Alaska?

How Alaska closed the hemp shelf
Gov. Mike Dunleavy asked an expert panel in 2023 to rewrite the state’s industrial hemp rules. That fall the Department of Natural Resources adopted rules that forbid the Division of Agriculture from endorsing “an industrial hemp product that contains delta-9-THC or a non-naturally occurring cannabinoid.” Without an endorsement, a hemp product cannot be sold in the state. Intoxicating products were pushed into the system Alaska already had for them, its licensed marijuana market.
The Alaska Industrial Hemp Association sued, arguing the rules violated the Supremacy Clause and the dormant Commerce Clause, took property without compensation and were too vague. Magistrate Judge Kyle Reardon rejected every argument on May 23, 2025.
Why some guides still say “legal”
A few national tables list Alaska as open. That reading confuses the two lanes. Alaska has had legal adult-use marijuana since 2014, so THCA-rich flower is easy to buy there. It is sold as marijuana, tested and taxed as marijuana, and only behind a licensed counter.
Federal changes hit sellers outside Alaska
Congress has made Dec. 11, 2026 the day THCA starts counting toward the federal 0.3 percent hemp limit; our hemp ban explainer has the statute and the earlier Nov. 12 date for cannabinoids the plant cannot make. Alaska already kept non-naturally occurring cannabinoids out of endorsed hemp, and its licensed stores sell flower under state marijuana law rather than the hemp definition, so local shelves barely move. The effect lands on hemp sellers in other states, who lose their federal footing for high-THCA flower bound for Alaska.
