Is THCA legal in Wyoming?
Wyoming wrote the decarboxylation test into its definition of hemp in 2024. A federal appeals court upheld it. There is no licensed cannabis market to fall back on.
The short answer: No. Wyoming defines hemp as having no more than 0.3 percent THC “when using post-decarboxylation or another similarly reliable testing method” (W.S. 11-51-101), a test that counts THCA. The 2024 law that added it was upheld by a federal appeals court in 2025, and Wyoming has no licensed cannabis market. Status as of Oct. 3, 2026.

The test is in the definition
Some states leave the testing method to regulators. Wyoming put it into the word “hemp.” Section 11-51-101(a)(iii) defines “hemp” or “hemp product” as the plant or anything made from it “with no synthetic substance and with a THC concentration of not more than three-tenths of one percent (0.3%) on a dry weight basis when using post-decarboxylation or another similarly reliable testing method.”
The definition of THC in the same section is broad: delta-9, its “psychoactive analogs,” and “any psychoactive structural, optical or geometric isomers of tetrahydrocannabinol.” A “synthetic substance” is “any synthetic THC, synthetic cannabinoid or any other drug or psychoactive substance.”
Post-decarboxylation is the lab step that turns THCA into delta-9. So in Wyoming, a bud’s THCA is measured as the THC it becomes. At 20 percent THCA, the result is more than 17 percent THC, nearly 60 times the limit.
Section 11-51-102 then says the possession, purchase, sale, transportation and use of hemp and hemp products “by any person is allowable,” but that permission applies only to material meeting the definition.
The court case
Hemp sellers challenged SF 32 soon after it passed. According to MJBizDaily, the U.S. Court of Appeals for the Tenth Circuit upheld the law on Oct. 27, 2025, in Green Room v. Wyoming. The law has been in effect since July 1, 2024 (MJBizDaily).
Conflict flag: at least one widely cited 50-state table lists Wyoming as “legal” for THCA. That is contrary to the statute’s text and the appellate ruling; we do not follow it.
No licensed route
Wyoming has no adult-use marijuana and no medical marijuana program. Flower that fails the hemp definition is marijuana under Wyoming’s controlled substances law, and there is no license under which an adult can buy it in the state.
The container cap is Wyoming’s only new rule
Federal law adopts Wyoming’s post-decarboxylation position on Dec. 11, 2026 (federal dates). The one new piece for the state is the federal cap of 0.4 milligrams of total THC per container on finished products.
