Is THCA legal in Utah?

Utah does not argue about THCA percentages for flower. It bans smokable hemp flower outright, and counts THCA in total THC for everything else.

The short answer: No. Utah bans smokable hemp flower outright: Utah Code 4-41-105 prohibits selling or using a cannabinoid product that is “smokable flower,” and bars bringing final products of 0.3 percent or more total THC into the state. Registered patients can buy flower from licensed medical cannabis pharmacies. Status as of Oct. 3, 2026.

Utah skips the percentage argument

Most of the national debate over THCA flower is about a number: does the 0.3 percent line count delta-9 alone or THCA too? Utah sidesteps it for flower. Among the things a person may not do under section 4-41-105 is “sell or use a cannabinoid product that is… smokable flower.” The ban does not depend on a lab result. A bag of hemp flower with no measurable THC is covered too.

The same section adds two more restrictions that matter to anyone ordering from out of state:

  1. It is prohibited to “transport into or out of the state extracted material or final product that contains 0.3% or more of total THC and any THC analog,” with a narrow exception for licensed transport of concentrate.
  2. It is prohibited to sell or give a cannabinoid product containing THC or a THC analog to anyone under 21 in the course of business.

THCA counts, by statute

For products that are not flower, Utah’s definitions do the work. Section 4-41-102 defines “total tetrahydrocannabinol” as “the sum of the determined amounts of delta-9-THC, tertrahydrocannabinolic acid, calculated as ‘total THC = delta-9-THC + (THCA x 0.877)’” (the misspelling is in the code). And section 4-41-402, as amended in 2026 and in force since July 1, 2026, says the sale or use of a cannabinoid product is prohibited unless the chapter allows it or the FDA has approved it; allowed products are the ones on the department’s registered list.

Utah’s ban on smokable hemp dates to 2020, as MJBizDaily reported at the time.

The medical lane

Utah’s medical cannabis program, created after voters passed Proposition 2 in 2018 and rewritten by the Legislature, lets cardholders buy cannabis, including flower in approved forms, at licensed medical cannabis pharmacies. Adults without a card have no lawful retail source for high-THCA flower in Utah. Section 4-41-402 also requires marketing for hemp products to tell consumers the product “is hemp or CBD and is not cannabis or medical cannabis.”

Registered hemp products and the cap

Utah’s flower ban is unaffected by the federal total-THC test that reaches THCA on Dec. 11, 2026 (federal change). The 0.4-milligram per-container cap may be stricter than some registered Utah hemp products, which the Department of Agriculture and Food will have to reconcile.
