Is THCA legal in Vermont?
Vermont's statute does the reclassifying itself: a hemp product over 0.3 percent total THC becomes a cannabis product. High-THCA flower belongs in licensed stores.

The short answer: Not as hemp. Vermont law, 6 V.S.A. 562, says hemp products exclude anything over 0.3 percent total THC on a dry-weight basis, and such a product “shall be considered a cannabis product.” High-THCA flower is sold legally by Cannabis Control Board-licensed retailers to adults 21 and over. The statute reclassifies the product
Vermont’s hemp chapter draws the line in two sentences. First, “hemp products” and “hemp-infused products” do not include any substance or product that “(i) is prohibited or deemed a regulated cannabis product by administrative rule of the Cannabis Control Board; or (ii) contains more than 0.3 percent total tetrahydrocannabinol on a dry-weight basis.”
Second, anything excluded that way “shall be considered a cannabis product as defined by 7 V.S.A. § 831(3),” with an allowance for people who hold a CCB license or hemp processor registration to possess it in line with that license.
The effect is that a high-THCA bud never sits in a legal gray zone in Vermont. It is either a cannabis product handled by a licensee or a cannabis product handled by someone without one.
A definition that moves with Washington
Vermont defines hemp itself as the plant “with the federally defined tetrahydrocannabinol concentration level of hemp.” That cross-reference matters this fall. When the federal definition changes, Vermont’s changes with it, without a vote in Montpelier. The statute also lets the Cannabis Control Board declare other hemp items regulated cannabis products by rule, which pulls them into licensed channels.
The licensed lane
Vermont opened adult-use retail sales in October 2022. CCB-licensed retailers sell flower that is tested and tracked as cannabis, and THCA levels on those labels match what is sold online as hemp elsewhere. Adults 21 and over can buy with ID. Possession over an ounce of cannabis, or over 5 grams of hashish, is an offense under 18 V.S.A. 4230.
The federal dates become Vermont’s dates
Vermont’s hemp definition points to the federal level, so the Nov. 12 cut for synthetics and the Dec. 11, 2026 switch to counting THCA (both dates explained) reach state law on the federal schedule. For flower, the outcome is what Vermont already does.
