Is THCA legal in Missouri?

Missouri is the rare state where THCA flower is still sold openly as hemp, and the state with a fixed date to stop it. HB 2641 takes effect Nov. 12.

The short answer: Yes as hemp, but only until Nov. 12, 2026. On that date Missouri’s HB 2641 makes hemp-derived intoxicating products marijuana under state law, sellable only by licensed dispensaries to adults 21 and over with a 0.4-milligram THC cap; THCA-rich flower is also sold in licensed dispensaries now. Status as of Oct. 3, 2026.

What HB 2641 does

Gov. Mike Kehoe signed HB 2641 on April 23, 2026. The bill creates the “Intoxicating Cannabinoid Control Act,” which provides that hemp-derived cannabinoid products are to be “included in the definition of ‘marijuana’” under the Missouri Constitution. From the effective date:

  • cultivation, manufacturing, testing, transport and retail sale of those products must be done solely by entities licensed by the Department of Health and Senior Services;
  • intoxicating hemp products are capped at 0.4 milligrams of THC, according to the signing coverage, and buyers must be 21;
  • violations are a class D felony with a $5,000 fine per transaction;
  • only licensed dispensaries may use the word “dispensary” in a business name.

The effective-date wrinkle

The House summary splits the timing. For hemp products the bill specifies, it takes effect Nov. 12, 2026. For other hemp-derived products, it takes effect Nov. 12 or, “if Congress delays the effective date of federal hemp restrictions,” applies only while federal restrictions are in force. Congress did delay the federal date for natural cannabinoids to Dec. 11. Whether THCA flower falls in the first group or the second depends on the final text; this desk treats Nov. 12 as the date for flower, the conservative reading.

The lawsuit

In July 2026 the MoHemp Trade Association, Lifted Liquids Inc. and MNG 2005 Inc. sued in the U.S. District Court for the Western District of Missouri, asking the court to declare the law unconstitutional and block it before Nov. 12. “There is no license we can apply for,” one plaintiff said. No ruling had been reported by Oct. 3.

If a court blocks HB 2641

A court win for sellers would buy them a month at most: federal law begins counting THCA in its hemp test on Dec. 11, 2026 (Hemp Ban Tracker).

As of Oct. 3, 2026, yes in the hemp-retail lane. Missouri has not yet applied a total-THC rule to hemp flower. That changes on Nov. 12, 2026, when HB 2641 takes effect.
