Is THCA legal in Nevada?

Most THCA guides say a 2025 bill banned hemp flower in Nevada. The Legislature's records say otherwise. The real constraints are a county ordinance, a sign law and a pending state rule.

The short answer: Through a licensed dispensary, yes, for adults 21 and over. As hemp, it is unsettled statewide and effectively closed in unincorporated Clark County, where a county ordinance in force since July 15, 2026 requires hemp shops to stay within the federal total-THC limit, THCA included. Status as of Oct. 3, 2026.

A correction to the usual story

Many state-by-state guides, and an earlier draft of our own research, say Nevada’s SB 356 of 2025 banned any consumable hemp with detectable THC and pushed THCA flower into dispensaries. We checked the primary record. The bill, sponsored by Sen. Lori Rogich, was referred to the Senate Commerce and Labor Committee in March 2025. The Legislature’s site holds the introduced text but no enrolled version, and the Cannabis Compliance Board’s June 18, 2025 summary of newly signed laws lists AB 504 and AB 76 but not SB 356. As of Oct. 3, 2026, we treat SB 356 as not enacted.

That does not make hemp THCA flower safe in Nevada. It means the constraints come from elsewhere.

The three rules that do apply

1. Clark County Ordinance 5354. The County Commission passed it on March 17, 2026; it took force on July 15, 2026 (signed ordinance). Hemp retail stores in unincorporated Clark County, which includes the Las Vegas Strip, must carry lot-specific results from a CCB-certified lab, and products “must contain no greater total THC concentration (including THCA) than permitted by federal law.” Where a lab keeps THCA intact, the THC figure is THCA times 0.877 plus delta-9. Stores may not sell products “intended to cause an intoxicating” effect, must bar customers under 21, and face misdemeanor penalties.

2. AB 504. Since Oct. 1, 2025, anyone without a cannabis license who sells hemp for human consumption must post “THIS LOCATION IS NOT LICENSED TO SELL CANNABIS” at each entrance and “ALL HEMP PRODUCTS CONTAIN LESS THAN THE LEGAL LIMIT OF THC” at each register, and may not claim a product is cannabis or intoxicating (AB 504, enrolled). Violations are deceptive trade practices that the CCB can refer to the attorney general.

3. The Department of Agriculture’s pending rule. Nevada’s statute lets the department set hemp’s THC ceiling (NRS 557.160). At a March 3, 2026 workshop on regulation R188-24, it proposed rewriting NAC 557 to define “Total THC” post-decarboxylation, matching 7 C.F.R. 990.1 (workshop minutes). We found no record of final adoption as of Oct. 3.

Conflict flag: reputable guides list Nevada as “banned” on the strength of SB 356. The statute and county records support “unsettled statewide, closed in Clark County.” We use the stricter reading for buyers.

The licensed lane

Nevada’s adult-use market is the lawful route. Licensed dispensaries sell flower that is routinely as high in THCA as hemp-labeled product, tested and tracked under Title 56. Adults 21 and over may hold up to 2.5 ounces.

Clark County tightens automatically

Clark County’s ordinance points to federal law, so its limit tightens on its own when federal law starts counting THCA on Dec. 11, 2026 (what changes federally). Statewide, high-THCA flower becomes federal marijuana whatever NAC 557 says.

Is THCA flower legal in Nevada?

Through licensed dispensaries, yes, for adults 21 and over. As hemp, the status is unsettled statewide and closed in unincorporated Clark County, where Ordinance 5354 has required hemp stores since July 15, 2026 to sell only products within the federal total-THC limit, THCA included.

Did Nevada SB 356 ban THCA flower?

No. SB 356 (2025) would have barred consumable hemp with THC above the limit of detection, but the Nevada Legislature lists no enrolled version, and the Cannabis Compliance Board's June 2025 summary of new laws does not include it. As of Oct. 3, 2026, it is not law.

How much cannabis can adults possess in Nevada?

Under NRS 678D, adults 21 and over may possess up to 2.5 ounces of usable cannabis and one-quarter ounce of concentrated cannabis.
