Is THCA legal in New Jersey?

New Jersey adopted the federal total-THC test eight months early and ended the sell-through on April 13. THCA flower now moves only through licensed dispensaries.

The short answer: Not as hemp. Since April 13, 2026, New Jersey has treated any hemp product with more than 0.4 milligrams of total THC per container as cannabis, and it bans online sales of hemp-derived products. THCA-rich flower is sold legally only by licensed cannabis retailers, to adults 21 and over. Status as of Oct. 3, 2026.

How New Jersey got ahead of Congress

The intoxicating-hemp law (A4509/S4509) was signed in January, before Gov. Phil Murphy left office, and took effect Jan. 13, 2026. Amendments under Gov. Mikie Sherrill followed on March 30. According to the CRC’s intoxicating hemp FAQ, the new definitions of hemp, cannabis and marijuana took effect on April 13, 2026, after a grace period for existing sellers to clear stock.

The definitions mirror the federal ones written into P.L. 119-37: hemp may hold no more than 0.3 percent total THC, counting THCA, delta-8 and similar cannabinoids, and finished products exceeding 0.4 milligrams of total THC per container are not hemp. A one-gram bag of high-THCA flower carries hundreds of times that cap. On New Jersey’s books it is cannabis.

Who may sell it now

The CRC says a Class 5 Cannabis Retailer is authorized to sell “hemp-derived cannabinoid products.” That is the same license that runs the state’s adult-use dispensaries. Smoke shops, gas stations and online stores lost the right on April 13. The commission’s FAQ is blunt on the internet: “Selling, offering to sell, or distributing any hemp-derived product or intoxicating hemp beverage online” is prohibited.

Beverages got a longer runway. Intoxicating hemp drinks may be sold until Nov. 13, 2026, by alcohol distributors or Class 5 retailers. After that, they follow everything else into the licensed channel or off the shelf.

Reading the map correctly

A red New Jersey on a hemp map is accurate and incomplete. The state has run adult-use cannabis sales since 2022, and THCA-rich flower is an everyday dispensary item. The plant did not become illegal for adults; the unlicensed route to it did.

What Dec. 11, 2026 adds

Very little, for New Jersey, whose rules already match the total-THC and 0.4-milligram standard federal law reaches on Dec. 11, 2026 (federal calendar). It matters more for shipments from states still selling under delta-9, which lose any federal hemp footing after Dec. 10.
