Is THCA legal in New York?
New York has measured hemp by total THC for years. Its CBD shops can sell hemp flower only below that line; high-THCA flower is a dispensary product.

The short answer: Not as hemp. New York’s hemp rules, 9 NYCRR Part 114, allow cannabinoid hemp products only up to 0.3 percent total delta-9 THC, a measure that counts THCA. One agency, two shelves
New York is unusual in putting hemp and cannabis under the same regulator. The Office of Cannabis Management licenses cannabinoid hemp processors and retailers under Part 114, and licenses adult-use dispensaries under the Cannabis Law. The line between the two shelves is drawn in total THC.
Part 114 requires cannabinoid hemp products to “contain no more than three-tenths of a percent (0.3%) total Δ9-Tetrahydrocannabinol concentration,” and it takes its definition of total THC from Article 1 of the Cannabis Law, which adds converted THCA to delta-9. The rule’s text on concentrated hemp products uses the same yardstick, capping them at 0.3 percent total THC by weight or volume.
That makes the math simple. THCA flower, which typically tests in the high teens or twenties, cannot be a cannabinoid hemp product in New York. On the hemp shelf it is noncompliant; on the dispensary shelf it is ordinary.
What a hemp shop may still sell
Part 114 does contemplate “flower products.” A licensed cannabinoid hemp retailer may sell hemp flower that stays under the total-THC line, and the rule requires an attestation that flower products and inhalable concentrates will not be sold to anyone under 21. Packaging must not appeal to minors, and products marketed for smoking carry a warning. These are CBD-type flower products, not the high-THCA flower sold online as hemp elsewhere.
The licensed route
Adult-use sales began in New York at the end of 2022 and have expanded through licensed storefront and delivery dispensaries. Flower sold there is tested and tracked as cannabis and sold only to adults 21 and over. OCM publishes a dispensary verification tool so buyers can confirm a shop holds a license, which is worth using in a market that still has unlicensed storefronts.
Part 114 versus the federal cap
New York already uses a total-THC test, so flower does not change category when federal law counts THCA from Dec. 11, 2026 (federal rule). The 0.4-milligram per-container cap is new, though, and far below what Part 114 allows for some ingestible hemp products. Expect OCM to revisit Part 114 after the federal date.
Practical notes for New York buyers
- Use OCM’s dispensary verification before buying cannabis in person or for delivery.
- A hemp product’s certificate of analysis should show total THC, not delta-9 alone.
