Is THCA legal in Ohio?

Ohio wrote the federal hemp definition into its own code in March, eight months early. Court orders protect a handful of plaintiffs, not the market.

The short answer: Not as hemp. Since March 20, 2026, Ohio’s SB 56 has defined hemp by total THC, THCA included, at 0.3 percent, and excluded finished products with more than 0.4 milligrams of total THC per container (ORC 928.01). Licensed adult-use dispensaries sell THCA-rich flower as marijuana to adults 21 and over. Status as of Oct. 3, 2026.

Ohio copied the federal text, early

SB 56 was a broad rewrite of the liquor, hemp and adult-use marijuana laws, and its hemp sections took effect March 20, 2026. The new definition in ORC 928.01 reads almost word for word like Section 781 of the federal law: hemp is the plant and its derivatives “with a total tetrahydrocannabinols concentration, including tetrahydrocannabinolic acid, of not more than three-tenths per cent on a dry weight basis.”

It then excludes from hemp any intermediate product above 0.3 percent combined total THC, any final product with “greater than four-tenths of a milligram combined total per container of total tetrahydrocannabinols, including tetrahydrocannabinolic acid,” and cannabinoids synthesized outside the plant. Ohio did not wait for Washington’s Nov. 12 or Dec. 11 dates; it adopted the federal standard eight months ahead.

State officials described the result plainly to Ideastream Public Media: intoxicating hemp “whether it was in a gummy form or flower form or in a drink form” was banned on March 20.

What the courts have and have not done

Hemp businesses sued in federal court, arguing among other things that the law discriminates against out-of-state commerce. According to KMK Law, the Northern District of Ohio has issued temporary restraining orders, most recently on Aug. 7, 2026, that bar enforcement of the hemp definition against the plaintiffs in one case. The firm’s advice to everyone else: keep complying with SB 56 until there is a final ruling.

Conflict flag: earlier reporting described a July 13 preliminary injunction covering about 10 beverage companies. The firm’s later account describes TROs limited to named plaintiffs. Either way, no order we found reopens Ohio to hemp THCA flower generally.

The licensed route

Ohio voters approved adult-use marijuana in November 2023, and dispensaries licensed by the Division of Cannabis Control sell flower to adults 21 and over. That flower is often as high in THCA as anything sold online as hemp. SB 56 also reworked parts of the adult-use law, including retail rules, so check the Division’s current guidance on purchase limits before buying.

Dec. 11, 2026: little changes in Ohio

Ohio’s definition already matches the federal one that reaches THCA on Dec. 11, 2026 (federal dates). SB 56 copied the federal words rather than cross-referencing them, so if Congress rewrites the text again, Ohio’s statute will not follow unless the General Assembly acts.

Did a court block Ohio's hemp ban?

Only for specific plaintiffs. Federal judges in the Northern District of Ohio have issued temporary orders covering named parties in pending lawsuits. As of Oct. 3, 2026, the law applies to everyone else.

Can hemp THC products be shipped to Ohio?

Not as hemp. State officials told Ideastream Public Media in April 2026 that no THC beverages can be sold or shipped to Ohio, and SB 56 removes flower above 0.3 percent total THC from the hemp definition altogether.
