Is THCA legal in Pennsylvania?

Pennsylvania's hemp lane is open under state law, but the bill that would close it is not dead. It came off the Senate table on Sept. 28.

The short answer: Yes as hemp, for now. Pennsylvania has no state rule that counts THCA toward hemp’s THC limit. SB 49, which would add one, failed on June 10, 2026 but was reconsidered and taken off the table on Sept. 28, so it can return to a vote. Federal law counts THCA from Dec. 11, 2026. Status as of Oct. 3, 2026.

SB 49: defeated, then revived

The bill’s record on the General Assembly’s site tells a story that most summaries cut short.

Correction: our earlier research described the bill as “defeated 29-21.” The 29-21 vote was the motion to reconsider; the defeat was 23-27. Because the defeat was reconsidered, the bill is still live on the Senate calendar.

What SB 49 would do to THCA

Printer’s No. 1805 would set up a Cannabis Control Board and move medical marijuana oversight to it. For hemp, its text adopts the federal language: hemp would be the plant “with a total tetrahydrocannabinols concentration, including tetrahydrocannabinolic acid, of not more than 0.3% on a dry weight basis.” It excludes intermediate products above 0.3 percent combined total THC and, borrowing the federal definition of a container as “the innermost wrapping, packaging or vessel,” defines final hemp-derived cannabinoid products by the per-container standard.

If enacted in that form, THCA flower would leave Pennsylvania’s hemp category. The bill still needs Senate passage, then House action and the governor’s signature.

The medical lane

Pennsylvania’s medical marijuana program lets registered patients buy flower, among other forms, at licensed dispensaries. Adults without a patient card have no licensed outlet; adult-use legalization has been debated in budget talks without passing.

Dec. 11, 2026 overrides the gap

Whatever happens to SB 49, Pennsylvania flower above the federal total-THC line, which counts THCA from Dec. 11, 2026 (federal timeline), is marijuana under federal law from that day, and federal law governs interstate shipment and the mail. The stopgap funding law also runs out Dec. 11, so a further delay is possible but not promised.

For Pennsylvania buyers

  • Look for both the THCA and the delta-9 line on a certificate of analysis, and the total THC figure that combines them.
  • Follow SB 49: a Senate vote would be the first signal the state window is closing ahead of the federal one.
