Is THCA legal in South Dakota?

South Dakota's hemp law and its drug law use different words for the same 0.3 percent line. That one word, 'total,' is where THCA flower's status turns.

The short answer: Contested. South Dakota’s hemp chapter defines hemp by “total delta-9” THC, a phrase that can count THCA, while its drug code exempts plants with 0.3 percent “delta-9.” Regulators have not resolved how high-THCA flower fits, so we treat the hemp lane as closed. Registered medical patients can buy from licensed dispensaries. Status as of Oct. 3, 2026.

Two statutes, two phrasings

Here is the problem in the state’s own words.

“Total delta-9” is the phrase federal testing rules use for delta-9 after THCA has been converted. On that reading, a high-THCA bud is not an industrial hemp product. The criminal code’s exemption omits “total,” which is the reading THCA sellers rely on. Courts have not reconciled the two as far as we could find.

There is a second wrinkle. The hemp chapter’s ban on “chemically derived cannabinoids” expressly does not cover “cannabinoids produced by decarboxylation from a naturally occurring” cannabinoid. So smoking or heating THCA, which converts it to delta-9, is not itself treated as chemical conversion.

What is settled

Converted products are out. HB 1125, signed in March 2024, banned chemically synthesized cannabinoids such as delta-8 made from CBD, effective July 1, 2024. A federal judge, Eric Schulte, denied a preliminary injunction on June 29, 2024, writing that the Legislature acted “squarely within the police powers traditionally reserved to states” (Marijuana Moment).

The medical lane

Voters approved medical cannabis in 2020, and the Department of Health licenses dispensaries that sell flower to registered patients. Adult-use cannabis has not been enacted. Adults without a card have no licensed outlet in the state.

Dec. 11, 2026 removes the ambiguity

The two-statute argument has an expiration date. Once THCA counts under federal law on Dec. 11, 2026 (federal change), high-THCA flower is federal marijuana in South Dakota whichever state definition one prefers.

For South Dakota buyers

  • Ask for a certificate of analysis that reports total THC; under the hemp chapter’s own wording, that is arguably the number that counts now, and federally it is the number from Dec. 11.
  • Patients should use licensed dispensaries.
