Is THCA legal in Oklahoma?
Many guides call Oklahoma open. The state's own hemp program administrator put it in writing in January: over 0.3 percent total THC, THCA counted, is not hemp.

The short answer: Not as hemp, according to Oklahoma’s hemp regulator. A Jan. 16, 2026 letter from the Department of Agriculture, Food and Forestry says hemp products must test at no more than 0.3 percent total THC, counting THCA, and anything above “cannot be marketed” as hemp. Licensed medical dispensaries serve card-holding patients. Status as of Oct. 3, 2026.

What the letter says
The one-page letter is signed by Joshua Rigdon, Hemp Program Administrator at the Oklahoma Department of Agriculture, Food and Forestry, and addressed to growers, processors, handlers and the public. Its key sentence: “Under current law hemp products are restricted to test no more than 0.3% Total THC (Total THC is measured as THC plus 87.7 percent of THCA).”
It calls that a “pre-existing restriction,” not a new one. It then explains the coming federal change and concludes that “products that are above the THC per container limit of 0.4 milligrams or the dry-weight restriction of less than 0.3% Total THC level are not considered hemp and cannot be marketed as such,” including anything added to hemp after harvest that pushes it over the line.
Two details to read with care. The letter was written before Congress moved the THCA date, so it gives Nov. 12, 2026 for the federal changes; the 0.4-milligram cap and the federal definition now apply to natural cannabinoids on Dec. 11. And the letter describes the federal cap as a future change, while describing the 0.3 percent total-THC limit as current law.
A correction, and a conflict
Our own earlier research, and several outside guides, called this an attorney general’s letter. It is hosted on ag.ok.gov, the agriculture department’s domain, and the letterhead is the department’s. We have corrected the attribution.
Conflict flag: most consumer guides list Oklahoma as open to THCA flower, and shops have sold it widely. The state agency that runs the hemp program says otherwise in writing. Following our practice of taking the stricter reading when credible sources disagree, we list Oklahoma’s hemp lane as closed. A court has not ruled on the question as far as we found.
The medical lane
Oklahoma’s medical marijuana program, approved by voters in 2018 and run by the Oklahoma Medical Marijuana Authority, is one of the largest in the country by number of licensed dispensaries. Patients with an OMMA card can buy flower there, including high-THCA flower, within program limits. Adults without a card have no licensed channel; voters rejected adult-use cannabis in March 2023.
ODAFF’s reading becomes federal law
When federal law starts counting THCA on Dec. 11, 2026 (federal change), the agriculture department’s January letter and federal law line up exactly, cap and all.
What Oklahoma buyers should take from this
