Is THCA legal in North Dakota?

North Dakota wrote the total-THC formula into its hemp statute and steered every other cannabis product into its medical program. There is no adult-use lane.

The short answer: No. North Dakota’s hemp chapter, NDCC 4.1-18.1, measures hemp by total THC, written as THCA times 0.877 plus THC, and leaves dried hemp off the list of products that may be sold. Anything outside that list falls under the medical marijuana law. There is no adult-use market. Status as of Oct. 3, 2026.

The formula is in the statute

Most states that count THCA do it by rule or by reference to federal testing guidance. North Dakota put the arithmetic into its code. Section 4.1-18.1-01 defines “total tetrahydrocannabinol” as “the sum of the percentage, by weight, of tetrahydrocannabinolic acid multiplied by eight hundred seventy-seven thousandths plus the percentage of weight of tetrahydrocannabinol.” Hemp is the plant with a total THC concentration set by the agriculture commissioner, and section 4.1-18.1-04.1 caps the commissioner at the federal limit.

Run a typical THCA flower through that formula. At 22 percent THCA and 0.2 percent delta-9, total THC is about 19.5 percent, sixty-odd times the federal ceiling.

Allowed products, and everything else

North Dakota then lists what a store may sell. Section 4.1-18.1-04.4 says “a person may only sell hemp and hemp commodities or products allowed under this chapter,” each with a certificate of analysis and a label reporting total THC. The list includes CBD and CBG products within the commissioner’s limits, hemp seed and oil, and items the commissioner approves in writing. It expressly excludes “hemp that has been chopped, separated, or dried for purposes of transfer or storage.”

The section closes the loop: “All other cannabis- or hemp-derived products that are not allowable hemp commodities or products under this chapter must be regulated in accordance with chapter 19-24.1,” the medical marijuana chapter. The same section bars sales of products containing chemically derived cannabinoids or delta-8 THC.

The only licensed route

North Dakota runs a medical marijuana program through state-licensed compassion centers, which may sell dried leaves and flowers to registered patients. Voters have not approved adult-use cannabis. An adult without a registry card has no lawful channel in the state for high-THCA flower.

CBD products and the federal cap

Flower rules do not move, since North Dakota already uses total THC, the test federal law applies to THCA from Dec. 11, 2026 (federal change). The per-container cap is another matter: the commissioner’s limits are tied to the federal ceiling, and some CBD products allowed today may exceed 0.4 milligrams of THC per package. Watch for updated guidance from the North Dakota Department of Agriculture.

What this means for a buyer

  • A hemp-labeled ounce of THCA flower shipped to Bismarck or Fargo is not an allowable hemp product under state law today, and from Dec. 11 it is not hemp under federal law either.
  • Patients should buy from compassion centers, which test and track product under the medical program.
  • This newspaper’s owner also sells flower in a separate market. Nothing on this page is an offer to sell into North Dakota.
