Is THCA legal in Montana?
Montana closed the hemp aisle in 2025 with one sentence of statute. Its licensed dispensaries still sell THCA-rich flower, as marijuana, to adults 21 and over.

The short answer: No, not as hemp. Since May 5, 2025, MCA 50-31-239 has barred selling consumers any hemp product that contains total delta-9 THC. High-THCA flower is still sold legally in Montana, as marijuana, by state-licensed dispensaries to adults 21 and over. Status as of Oct. 3, 2026.

The one sentence that closed the hemp lane
Montana did not write a long hemp code. It wrote one prohibition. The statute reads: “Unless authorized as a food or drug by the United States food and drug administration, a hemp product containing total delta-9 tetrahydrocannabinol (THC) may not be sold to a consumer in the state.”
Three words carry the weight. “Total” means THCA counts once converted to its delta-9 equivalent, the way a lab does it. “Containing” sets no threshold, so the ban is not limited to products above 0.3 percent. “Consumer” is defined as a member of the public who takes possession and does not resell, which aims the rule at the retail counter rather than the farm.
The statute’s own definition of “hemp product” covers anything containing postharvest hemp that is “intended for consumption, smoking, vaping, or another method of administration.” Smokable flower sits squarely inside it.
The Montana Department of Revenue, which licenses the state’s cannabis businesses, summarized the bill in its 2025 legislative updates and lists the enforcing agency as the Department of Public Health and Human Services.
Where adults buy THCA-rich flower legally
Montana voters approved adult-use marijuana in 2020, and the licensed market is the lawful channel. A dispensary’s flower is often as high in THCA as anything marketed online as hemp. The difference is paperwork: it is grown, tested, tracked and taxed as marijuana under Title 16, Chapter 12, and sold only to adults 21 and over.
So a map that paints Montana red for THCA is describing the hemp aisle alone. For an adult with a valid ID, the product is a short drive away in most of the state.
Possession and carrying
Possession limits apply to marijuana bought at a dispensary: 1 ounce of usable marijuana, of which no more than 8 grams may be concentrate, and edibles capped at 800 milligrams of THC. Hemp-labeled flower bought out of state gets no separate allowance under these rules, and no Montana store may lawfully sell it to you as hemp.
Federal law arrives 19 months late
Federal law starts counting THCA toward the hemp limit on Dec. 11, 2026 (statute and dates), 19 months after Montana did. Shoppers here see little change. What shifts is interstate shipping: flower above the line becomes federal marijuana in transit as well as on arrival.

- Ask whether the seller is a Montana-licensed dispensary. If not, it is selling through the closed lane.
- A certificate of analysis showing low delta-9 alone does not answer Montana’s question; look for the total THC line.
