Is THCA legal in Nebraska?
Nebraska's statute still reads delta-9 only, and the ban bill stalled again in April. The attorney general has not stopped pressing sellers, and Dec. 11 changes the federal ground.

The short answer: For now, yes, as hemp, but on narrow ground. Nebraska’s hemp definition, Neb. Rev. Stat. 2-503, still measures only delta-9 THC, and the ban bill LB 316 was indefinitely postponed on April 17, 2026. What the statute actually says
Section 2-503 defines hemp as the plant and “all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers… with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.” It adds that hemp “shall not be considered a controlled substance under the Uniform Controlled Substances Act.”
The definition was last amended by LB 262 in 2024. It does not mention THCA, total THC or decarboxylation. On the statute’s plain words, flower that tests low in delta-9 is hemp in Nebraska no matter how much THCA it carries.
That plain reading is what sellers rely on. It is also why the state’s top law officer has gone around the statute rather than through it.
LB 316 and the attorney general
LB 316, introduced by Sen. Kathleen Kauth of Omaha and backed by Attorney General Mike Hilgers, would have classed hemp products over 0.3 percent of any form of THC as marijuana. It stalled in May 2025 when opponents blocked amendments (Nebraska Examiner) and was indefinitely postponed on April 17, 2026 (LegiScan).
The attorney general’s office has not waited for lawmakers. It has filed suits against retailers and an out-of-state manufacturer under the Consumer Protection Act and the Nebraska Pure Food Act, and sent cease-and-desist letters to shops across the state (Nebraska Attorney General). Those cases target labeling, marketing and synthetic products rather than the delta-9 definition itself, but they raise the cost of running a THC shop in Nebraska.
No licensed lane for adults
Nebraska has no adult-use marijuana program. Voters approved medical cannabis measures in November 2024, and that program serves qualifying patients, not the general adult public. For an adult who is not a patient, the hemp aisle is the only legal channel, and it is the one Congress is about to narrow.
A state-federal gap after Dec. 10
Nebraska’s definition does not follow federal changes, so once federal law counts THCA from Dec. 11, 2026 (federal timeline), flower that is hemp under state law becomes marijuana under federal law. State law cannot authorize what federal law prohibits, and the Postal Service treats controlled substances as nonmailable. Expect the Legislature’s 2027 session, which opens in January, to take the question up again.
Practical notes for Nebraska buyers
- Check that a certificate of analysis lists both delta-9 and THCA, and note the total THC line; it is the number federal law reads from Dec. 11.
- Watch the attorney general’s actions: a product pulled for labeling can disappear from a shelf even while the statute is unchanged.
