Is THCA legal in Kentucky?
Kentucky grew hemp before most states did, and it never let raw buds go straight to consumers. The rule is short, specific and still in force.

The short answer: Not as raw flower. Kentucky’s hemp regulation, 302 KAR 50:070, prohibits selling whole hemp buds, ground floral material or ground leaf material to anyone who is not a licensed hemp business, so THCA flower cannot be sold to Kentucky consumers as hemp; the state’s medical program is the only licensed cannabis lane. The rule, line by line
Section 1(2) of 302 KAR 50:070 lists products that may not be “marketed, sold, or distributed” to unlicensed persons in Kentucky, or to unauthorized entities in other states. The list includes:
- “whole hemp buds”
- “ground hemp floral material”
- “ground hemp leaf material”
- any hemp product with a delta-9 THC concentration above 0.3 percent
Those materials may move only between Kentucky Department of Agriculture licensees and authorized institutions or agricultural entities elsewhere. Section 1(3) sets civil penalties of $100 to $1,000 per violation, and a license can be terminated.
The first three items do not depend on THC at all. A bud with a perfectly compliant delta-9 reading is still a whole hemp bud, and selling it to a member of the public is off-limits.
What Kentucky does allow
Kentucky’s hemp market runs on processed products: oils, edibles, drinks and topicals that are registered with the state and sold to adults 21 and over. The line between “processed” and “floral material” is the one that matters for anyone shopping. Grinding flower into a pre-roll does not obviously make it processed under this rule, which names ground floral material specifically.
Processed products take the hit
Kentucky already keeps raw flower from consumers, so the federal total-THC test for THCA on Dec. 11, 2026 (how it works) lands hardest on processed products, many of which exceed the new 0.4-milligram container cap. The state’s registered product list will also need to drop items built on converted cannabinoids, which lose federal hemp status the same day, and any built on cannabinoids the plant cannot make, which go on Nov. 12 (H.R. 6500, Sec. 2019).
