Is THCA legal in Maryland?

Maryland drew its hemp line at half a milligram per serving. Anything stronger, THCA flower included, belongs to licensed dispensaries.

The short answer: Only through a licensed dispensary. Since July 1, 2023, Maryland has reserved any product meant to be consumed or inhaled with more than 0.5 milligrams of total THC per serving, or 2.5 milligrams per package, for Maryland Cannabis Administration license holders, so THCA flower is sold legally in the state only as cannabis, to adults 21 and over. Status as of Oct. 3, 2026.

The thresholds

Gov. Wes Moore signed the Cannabis Reform Act on May 3, 2023. It created the Maryland Cannabis Administration to license the legal market and gave the Alcohol, Tobacco, and Cannabis Commission (ATCC) the job of policing everyone else. The ATCC’s Advisory 24-002 spells out the result for hemp:

  • Only an MCA license holder may sell or distribute cannabis products “intended for human consumption or inhalation” with more than 0.5 milligrams of total THC per serving or 2.5 milligrams per package.
  • That covers delta-8, delta-9 and delta-10 THC “regardless of how derived,” plus any other cannabinoid the MCA finds intoxicating.
  • Products with non-naturally occurring cannabinoids, such as THC-O, may not be sold in Maryland at all, licensed or not.

A gram of flower with 20 percent THCA contains roughly 175 milligrams of potential THC. No bag of THCA flower comes anywhere near the 2.5-milligram package threshold.

What unlicensed stores may still sell

The advisory lists what remains: hemp products not meant to be consumed or inhaled, such as lotions, balms, salves and pet CBD, and consumables “with only trace amounts of THC.” The ATCC directed retailers to remove anything above the thresholds from their shelves.

The 2.5-milligram line meets the federal cap

Maryland’s 2.5-milligram package line for unlicensed sellers is above the 0.4-milligram per-container cap federal law sets on Dec. 11, 2026 (federal change), so some trace-THC products legal in Maryland shops today will not be hemp federally. Dispensary sales continue under state law, and Maryland already bans the synthetic cannabinoids that lose federal status on Nov. 12.
