Is THCA legal in Michigan?

Michigan wrote THCA into its definition of THC in 2021. Since then, high-THCA flower is marihuana there, sold by licensees and nobody else.

The short answer: Only through a state-licensed business. Since 2021, Michigan law has defined THC to include tetrahydrocannabinolic acid “regardless of whether it is artificially or naturally derived,” which makes high-THCA flower marihuana that only Cannabis Regulatory Agency licensees may sell, to adults 21 and over. The definition that does the work

Michigan’s marihuana statutes now define THC broadly. Under MCL 333.27953, as amended by 2021 PA 56, THC includes “tetrahydrocannabinolic acid” and “tetrahydrocannabinol, regardless of whether it is artificially or naturally derived,” along with its isomers. Industrial hemp is cannabis with a THC concentration of 0.3 percent or less, and with THCA folded into THC, high-THCA flower cannot meet that line.

The legislature also told the regulator to set total-THC limits for hemp products intended for consumption. The result is that the hemp argument used in other states, low delta-9 on a certificate, has no purchase in Michigan.

The regulator’s position

In October 2021, the Cannabis Regulatory Agency issued a bulletin stating that it is unlawful to manufacture, possess, transfer, sell or give away these products without a CRA license. The agency has since pursued unlicensed sellers of hemp-derived THC products. National guides that list Michigan as “open retail” are describing what some shops do, not what the statute permits.

A large licensed market

Michigan is one of the biggest adult-use markets in the country, so buyers are not short of options. THCA-rich flower in a licensed store is grown, tested and tracked as marihuana, with state labels and packaging. That is the product the law recognizes.

Five years behind Michigan

Michigan’s 2021 definition already reached artificially derived THC and counted THCA; federal law catches up on Nov. 12, 2026 for cannabinoids the plant cannot naturally produce and on Dec. 11 for THCA and converted plant cannabinoids (federal dates; H.R. 6500, Sec. 2019). The two definitions will largely agree, five years apart, and licensed retail continues under state law.
