Is THCA legal in Louisiana?

Louisiana once allowed floral hemp. Act 752 reversed that on Jan. 1, 2025, and wrote one of the tightest hemp-edible regimes in the South.

The short answer: No. Louisiana’s Act 752 of 2024 reversed prior law that allowed floral hemp and has prohibited its sale, production and distribution since Jan. 1, 2025; THCA-rich flower is available legally only to medical marijuana patients through the state’s licensed pharmacies. Status as of Oct. 3, 2026.

What Act 752 changed

The Legislature’s résumé digest of HB 952 lays out the shift plainly: “Prior law allowed the sale, production, and distribution of floral hemp material. New law prohibits the sale, production, and distribution of floral hemp material.”

Act 752 also bars converting cannabinoids that are not naturally occurring into consumable hemp products, and it limits hemp sales on premises holding an alcohol permit unless the business was permitted for hemp by June 17, 2024.

A preemption clause that points one way

Louisiana’s old law said the state’s rules would yield to any federal rule that was less restrictive. Act 752 flipped it: state law now yields to federal rules that are more restrictive. That clause matters on Dec. 11.

Preemption makes the federal cap control

Louisiana’s 5-milligram serving and 40-milligram package limits sit far above the 0.4-milligram per-container cap federal law applies from Dec. 11, 2026 (federal rule), and Act 752’s preemption clause makes the stricter federal number the one that governs. A Louisiana hemp-beverage group said in July 2026 that it is lobbying for a federal regulatory alternative. Cannabinoids the plant cannot naturally produce, which Act 752 already keeps out of Louisiana consumables, lose federal hemp status Nov. 12; converted plant cannabinoids such as delta-8 follow on Dec. 11 (H.R. 6500, Sec. 2019).
