Is THCA legal in Maine?

Maine kept the delta-9 hemp test and built a 21+ category around it in 2025. That leaves THCA flower in a narrow, regulated hemp lane, until federal law closes it.

The short answer: In a restricted hemp lane, for now. Maine still defines hemp by delta-9 THC, and a 2025 law, PL 2025 c. 416, made “potentially intoxicating hemp products” 21+ with child-resistant packaging; adults can also buy THCA-rich flower as cannabis in the state’s licensed adult-use stores. What the 2025 law built

Maine’s hemp statute, 7 M.R.S. § 2231, still uses the federal 2018 test: hemp has “a delta-9-tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis.” PL 2025 c. 416 left that alone and added a category on top of it.

A “potentially intoxicating hemp product” is an ingestible hemp product that fails either of two tests: it has 0.3 percent or more potentially intoxicating cannabinoids, or its ratio of nonintoxicating to potentially intoxicating cannabinoids is 10 to 1 or less. Those products:

  • may not be sold to anyone under 21;
  • must be in child-resistant, tamper-evident packaging unless they are beverages, salves or topicals;
  • may not be labeled in a way that would confuse a buyer with a trademarked product.

The open question for flower

The statute does not expressly ban hemp flower, and it does not expressly say that smokable flower is an “ingestible” product inside the new category. One national guide lists the state as open retail. This desk calls it restricted: legal under the delta-9 definition, with an age and packaging regime that a careful seller applies to flower too.

Maine’s delta-9 test and federal law split

Dec. 11, 2026 matters most here: federal law starts counting THCA in the hemp limit (federal timeline) while Maine’s definition still reads delta-9, so high-THCA flower sold as hemp becomes federal marijuana regardless of state law. Adult-use stores keep selling under state law. A 2026 initiative to repeal adult-use cannabis did not qualify for the Nov. 3 ballot (our ballot report).
