Is THCA legal in Hawaii?

Hawaii does not run the THC math on hemp flower. It bans the format outright, at any potency, and now requires online sellers to register too.

The short answer: No. Hawaii prohibits the sale of hemp flower, leaf material and pre-rolls “regardless of the labeled percentage or amount” of THC, so THCA flower is banned as hemp at any potency; the only legal route to cannabis flower is the state’s medical dispensary program for registered patients. Status as of Oct. 3, 2026.

A ban on the form, not the number

Most states that close the hemp lane do it with arithmetic: count THCA, compare to 0.3 percent, reject the flower. Hawaii skipped that step. The Department of Health’s list of prohibited products starts with “all viable hemp seeds, hemp flower or leaf material, including hemp pre-rolls,” regardless of the THC on the label. A certificate of analysis showing a compliant delta-9 number does not help, because the number is not the test.

Inhalable hemp products are prohibited as well. What remains on Hawaii shelves are manufactured products such as tinctures, gummies, topicals and beverages, with oil-based tinctures limited to buyers 21 and over who show ID.

The registry reaches online sellers

From January 2026, anyone selling manufactured hemp products to Hawaii consumers needs a Certificate of Registration from the department, and that includes online sellers. The registry is how the department can trace a product sold into the islands from the mainland. A seller that ships flower to Hawaii would be shipping a prohibited product, registered or not.

Local reporting in August 2026 described the islands’ intoxicating-hemp market as having largely disappeared after the rules took hold.

Stricter on flower, looser on gummies

Hawaii is already stricter on flower than the federal total-THC test that reaches THCA on Dec. 11, 2026 (the federal dates). The federal limit of 0.4 milligrams of total THC per container is what matters locally: some gummies and drinks now sold under state rules may exceed it.

  • Registered medical patients buy flower from licensed dispensaries.
  • No hemp flower or pre-roll can be lawfully sold to Hawaii consumers, by shop or by mail.
