Is THCA legal in Illinois?

Illinois is one of the few states with its own Nov. 12 deadline. That day, a new Illinois Hemp Act counts THCA and ends smokable hemp sales, a month before federal law does.

The short answer: For a few more weeks, in a 21+ hemp market; after Nov. 12, 2026, only at licensed dispensaries. Illinois Public Act 104-463, signed June 12, 2026, made intoxicating hemp 21+ immediately and replaces the state’s hemp law on Nov. 12 with a total-THC definition that counts THCA and bars hemp products meant for smoking. What changed on June 12

Gov. JB Pritzker signed SB 3222 on June 12, 2026. Two things applied at once. Any cannabinoid product with more than 0.4 milligrams of THC or THC-like compounds may be sold only to people over 21, with an ID check for anyone who appears under 30. And every hemp product now needs a label listing its cannabinoids, including total THC; for flower, percentages by weight are acceptable.

What changes on Nov. 12

The Illinois Department of Agriculture’s June bulletin lays out the second stage. On Nov. 12, the Industrial Hemp Act is repealed and replaced by the Illinois Hemp Act, which adopts this definition:

hemp … with a total tetrahydrocannabinol concentration (including tetrahydrocannabinolic acid) of not more than 0.3 percent on a dry-weight basis.

The new act also says final consumer hemp products “cannot be intended for smoking or vaping,” must be prepackaged in child-resistant containers, and must be lab-tested with a scannable COA. Anything that fails the hemp definition is cannabis under state law. Selling cannabis without a license is a crime under the Cannabis Control Act, with penalties the department describes as ranging from a Class B misdemeanor to a Class X felony depending on amount.

Illinois chose Nov. 12 when that was still the federal date. Congress later moved the federal date for natural cannabinoids, but the Illinois date did not move with it.

Dec. 11: federal law follows a month later

Federal law adds THCA to its hemp test on Dec. 11, 2026 (federal timeline), a month after the Illinois Hemp Act does the same. It closes nothing new here; it mainly removes any federal cover for flower shipped in from other states. CRTA dispensaries continue as before.
