Is THCA legal in Indiana?
Most national maps list Indiana as open. They skip a 2019 statute that criminalizes smokable hemp, which a federal appeals court left standing.

The short answer: Not as flower meant for smoking. Indiana’s 2019 law makes it a crime to manufacture, deliver or possess “smokable hemp,” and the 7th Circuit left that law in place except for shipments passing through the state; Indiana also has no medical or adult-use cannabis program. The statute most maps leave out
Senate Enrolled Act 516 added Indiana Code 35-48-4-10.1. It covers anyone who “manufactures, finances the manufacture of, delivers, finances the delivery of, or possesses smokable hemp.” Smokable hemp is a hemp product in a form that lets THC be introduced into the body by inhaling smoke. The definition turns on the form, not on a THCA percentage.
Indiana hemp shops sell flower anyway, and national guides usually list the state as open. This desk does not. A product that is sold, bought and used as smokable flower is what the statute describes, and a disclaimer on the bag does not obviously change that.
What the 7th Circuit decided
Hemp businesses challenged the law in C.Y. Wholesale v. Holcomb. On July 8, 2020, the 7th Circuit held that states may bar the manufacture of smokable hemp, because the 2018 Farm Bill lets them set stricter rules. It also held that Indiana may not block smokable hemp from moving through the state to somewhere else, and limited the injunction to that transit and to the possession and delivery rules only insofar as they interfere with it. The rest of the statute stands.
The 2026 session
SB 250, which would have gone further and banned intoxicating hemp products broadly, died at the legislative deadline on Feb. 24, 2026. Its failure left the 2019 law exactly where it was.
The 2020 transit ruling loses its footing
On Dec. 11, 2026, high-THCA flower stops being hemp under federal law (federal change). The 7th Circuit’s transit protection rested on a product being federal hemp, so it no longer covers that flower. Indiana’s delta-8 gummies and vapes, made from CBD outside the plant, lose federal hemp status on the same date; only cannabinoids the plant cannot naturally produce go earlier, on Nov. 12 (H.R. 6500, Sec. 2019).
