Is THCA legal in Idaho?
Idaho writes THCA into its definition of hemp in plain words. Flower above 0.3 percent total THC is marijuana there, and the state has no licensed lane at all.

The short answer: No. Idaho’s controlled-substances law defines hemp by its total delta-9 THC, “including both delta-9 tetrahydrocannabinol and delta-9 tetrahydrocannabinolic acid (THCA),” so THCA flower over 0.3 percent is marijuana in Idaho, and the state has no medical or adult-use program to sell it through. Status as of Oct. 3, 2026.

THCA is named in the statute
Many states leave the THCA question to regulators or lab conventions. Idaho put it in the code. The hemp exclusion in Idaho Code 37-2701 covers Cannabis sativa “with a measured total delta-9 tetrahydrocannabinol concentration of not more than three-tenths of one percent,” and it says the measurement includes THCA “evaluated by decarboxylation during analysis.”
That leaves no gap for the argument hemp sellers make elsewhere, that a flower is hemp because its delta-9 reading is low. In Idaho, the decarboxylated number is the number. Everything that fails it is marijuana, and the hemp definition also requires that the plant be handled under a license or an approved state plan.
On the shelf, the standard is stricter still. Testifying for HB 879 before a Senate committee on March 24, 2026, the Idaho Farm Bureau’s lobbyist said “any legal hemp product must not contain any amount of THC,” and the director of the state agriculture department confirmed that current law “was very specific about total THC.”
HB 879 brings retailers under the rules
HB 879, taken up in the 2026 session, closes what its supporters called a gap: it states that establishments selling hemp products meant to be eaten or inhaled are subject to the Industrial Hemp Research and Development Act. A Boise police officer told the committee he had found products imported from other states labeled THC-free that failed state lab tests. Hemp seed, seed oil and seed protein are exempt.
Washington adopts Idaho’s test
On Dec. 11, 2026 federal law starts counting THCA, the test Idaho already writes into its code (federal background). Idaho never let converted cannabinoids such as delta-8 be sold as hemp either, so neither their federal exit on Dec. 11 nor the Nov. 12 cut for cannabinoids the plant cannot make (H.R. 6500, Sec. 2019) changes its shelves. The two definitions simply stop diverging.

- There is no lawful source of THCA flower in Idaho as of Oct. 3, 2026.
- Neighboring states with adult-use markets do not change Idaho law; bringing flower across the border brings marijuana into Idaho.
