Is THCA legal in Colorado?

Colorado sorted cannabinoids into three tiers in 2023 and handed the intoxicating tier to its marijuana regulator. THCA flower lives on the licensed side.

The short answer: Only through a licensed marijuana business. Colorado’s SB 23-271, signed June 7, 2023, reserves products with intoxicating cannabinoids for businesses licensed by the Marijuana Enforcement Division, so THCA-rich flower is sold in the state as marijuana to adults 21 and over, not as hemp. Three tiers, one license line

SB 23-271 sorts cannabinoids into nonintoxicating, potentially intoxicating and intoxicating. Only the first group can be made and sold as an ordinary hemp product. The bill’s summary is direct: products containing potentially intoxicating or intoxicating cannabinoids “must only be produced, distributed, or sold by a person licensed by the division.”

For edible-style hemp products the law also sets serving and ratio thresholds, which is why Colorado hemp shelves carry CBD-heavy goods with small amounts of THC. Flower that tests high in THCA is not a ratio question. It is a product built around an intoxicating cannabinoid, and in Colorado that belongs to the licensed system that voters created in 2012 with Amendment 64.

Enforcement

Violations carry civil penalties of up to $10,000 per violation per day. Colorado has paired its hemp program with marijuana regulators rather than leaving intoxicating hemp to agriculture inspectors, which is the main reason gas-station THC never took hold there the way it did in states with no adult-use market.

What the federal switch leaves alone

THCA enters the federal hemp definition on Dec. 11, 2026 (details on the change). Colorado’s licensed stores sell under the state constitution and MED rules, so their flower stays on sale, and the state’s hemp growers already test crops for total THC at harvest. Converted products such as delta-8 lose federal status that same day, and Colorado already restricts most of them in its intoxicating tiers; only cannabinoids the plant cannot naturally produce go earlier, on Nov. 12 (H.R. 6500, Sec. 2019).
