Is THCA legal in Delaware?

Delaware's statute books point two ways on THCA flower, and the bill meant to settle it stopped in a Senate committee. The licensed lane, open since 2025, is the clear one.

The short answer: Delaware’s hemp lane is unsettled, so this desk does not call THCA flower legal there as hemp. The state’s hemp definition uses the old delta-9 test, but its Schedule I lists any material containing tetrahydrocannabinols with no express hemp carve-out, and the bill meant to resolve the question stalled in June; the clear lane is Delaware’s licensed adult-use stores, which sell THCA-rich flower to adults 21 and over. Why the statutes point two ways

The hemp side. Title 3, § 2801 defines industrial hemp as cannabis with “a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.” Title 16, § 4701 then excludes industrial hemp from the definition of marijuana. On that reading, a flower that tests under 0.3 percent delta-9 is hemp, whatever its THCA.

The controlled-substance side. Title 16, § 4714(d)(19) lists in Schedule I any material “which contains any quantity of marijuana or any tetrahydrocannabinols” not approved by the FDA. That line has no hemp exception of its own. Some readers argue it reaches hemp-derived THC regardless of the marijuana definition.

Neither the state’s courts nor its regulators have resolved the conflict for THCA flower in a document this desk could find. Until one does, a buyer is relying on the first reading.

The bill that stopped

HB 395, introduced April 30, 2026, would have moved hemp-derived cannabinoids into the licensed marijuana system with a 0.3 percent total-THC definition and a 0.4-milligram per-container limit. It passed the House and went to the Senate Health & Social Services Committee on June 16, where it remained when the session ended June 30. A competing approach, a substitute for HB 401 creating a “Delaware Hemp Regulation Act” with 21+ retail licenses, cleared a House committee on June 30 and went no further.

Why § 2801’s wording stops mattering

Once THCA counts toward the federal hemp limit on Dec. 11, 2026 (federal timeline), high-THCA flower is marijuana under federal law in Delaware however § 2801 is read, unless Congress moves the date again. Converted delta-8, a large share of what Delaware gas stations sell, loses federal hemp status the same day; the Nov. 12 date reaches only cannabinoids a cannabis plant cannot produce naturally (H.R. 6500, Sec. 2019). Licensed stores keep selling under state law.

Practical points for Delaware

  • Licensed adult-use stores, open since 2025, are the lane with no legal question attached.
  • Hemp-shop flower is sold without state testing, age or packaging rules, per the legislature’s own description.
